Florida man shot and killed Burger King employee over delayed $40 food order

Desmond Armond Joshua Jr., 22, was hired on Thursday to work at Burger King on East Colonial Drive. Two days later, he was dead after an apparent dispute over delayed food.

Joshua was working about 7:15 p.m. Saturday at the Burger King restaurant when the drive-through line became backed up and food orders were slow to come out. An irate customer began banging on the drive-thru window and threatened to bring her \u00e2\u0080\u009cman\u00e2\u0080\u009d back to the restaurant, according to an affidavit.

The woman, who was in a Honda Accord, was given a refund for her $40 order and told to leave.

She returned with her longtime boyfriend, Kelvis Rodr\u00c3\u00adguez Tormes, 37, who was driving a white pickup truck with the logo for SGL Constructors, which is the main contractor for the I-4 Ultimate project.

\u00e2\u0080\u009cYou got two seconds before I shoot you,\u00e2\u0080\u009d Rodr\u00c3\u00adguez Tormes told Joshua, according to the affidavit.

After a brief scuffle Joshua was shot once in the chest in the parking lot. He was taken to AdventHealth Orlando East, where he was pronounced dead.

Deputies were able to locate the SGL truck. The woman was at the home and Rodr\u00c3\u00adguez Tormes drove up in another vehicle shortly thereafter. His girlfriend said Rodr\u00c3\u00adguez Tormes told her he \u00e2\u0080\u009cmessed up.\u00e2\u0080\u009d

Rodr\u00c3\u00adguez Tormes is facing a first-degree murder charge, along with possession of a firearm by a convicted felon and destruction of evidence because he dismantled the gun and ditched it somewhere, refusing to tell deputies where it was, according to the affidavit.
