LEGAL AGREEMENT: TERMS OF USE

PLEASE READ CAREFULLY. BY ACCESSING THIS WEBSITE, YOU ARE ENTERING INTO A BINDING LEGAL AGREEMENT.

These Terms of Use (“Terms”) govern your access to and use of Arre.st, owned and operated by US Support LLC, a Nevada news syndicate (“we,” “us,” or “our”). By accessing or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. JURISDICTION AND GOVERNING LAW

You hereby acknowledge and agree that:

  • You are accessing a private server physically located in the State of Nevada, United States.
  • Any and all interactions with Arre.st are subject exclusively to the laws of the State of Nevada and applicable Federal laws of the United States.
  • Any legal action or proceeding arising out of or relating to these Terms shall be instituted exclusively in the courts of the State of Nevada.
  • You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

2. NO FEES FOR REMOVAL OR ALTERATION

Arre.st does not charge any fees for removal, alteration, or modification of any mugshot, arrest record, or other information displayed on this website. Any request for removal or modification will be evaluated according to our internal policies and applicable laws of the State of Nevada and applicable Federal laws of the United States.

3. NO ADVERTISING, DATA SELLING, OR MONETIZATION

Arre.st does not sell advertising space on its platform. Additionally, Arre.st does not engage in any of the following revenue-generating practices:

  • We do not sell, trade, rent, or otherwise transfer user data to third parties for marketing, advertising, or other commercial purposes;
  • We do not monetize through affiliate marketing or sponsored content;
  • We do not offer premium features, subscriptions, or paid tiers;
  • We do not collect or sell aggregated user statistics or analytics;
  • We do not accept payment for preferential treatment, enhanced listings, or priority placement of information;
  • We do not utilize targeted advertising technologies or ad networks;
  • We do not generate revenue through lead generation activities.

Arre.st is not currently monetized in any way and operates solely as an information service provided by US Support LLC, a Nevada news syndicate.

4. PUBLIC RECORDS

All information provided on Arre.st is derived from public records made available by governmental agencies. We make no guarantees or warranties regarding the accuracy, completeness, or timeliness of the information displayed.

5. DISCLAIMER OF WARRANTIES

THE INFORMATION PROVIDED ON ARRE.ST IS PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ARRE.ST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF ARRE.ST.

7. NEWS SYNDICATE STATUS AND FIRST AMENDMENT PROTECTION

Arre.st is operated by US Support LLC, a Nevada news syndicate. All content published on this site constitutes the dissemination of factual public records as part of legitimate news reporting and journalistic activity. The publication of such information is protected under the First Amendment of the United States Constitution and enjoys the full legal protections afforded to news media organizations.

8. JURISDICTIONAL RESTRICTIONS

This website is intended for access by users in jurisdictions where viewing and accessing this content is permitted under local law. Users are solely responsible for determining whether their access to and use of Arre.st complies with applicable local, state, and federal laws in their jurisdiction. The information provided on Arre.st consists solely of public records lawfully obtained from government agencies or their authorized third-party contractors that are or were in the public domain. Users acknowledge that:

  • The First Amendment of the United States Constitution protects the publication and dissemination of truthful information obtained from government records that are open to public inspection;
  • Arre.st functions as a news reporting service, and courts have consistently recognized stronger constitutional protections for entities engaged in news reporting and journalism;
  • The publication of arrest records and mugshots serves legitimate public interests, including governmental transparency, accountability in the criminal justice system, and public safety;
  • No images or information are substantively modified, enhanced, or altered from their original form as provided by government agencies, beyond the addition of a watermark for source attribution;
  • The United States Supreme Court has recognized in multiple decisions that republishing matters of public record is constitutionally protected.

13. COMMUNICATIONS DECENCY ACT PROTECTION

As an interactive computer service provider under 47 U.S.C. § 230, Arre.st is immune from liability for content that originates from third parties or government sources. The Communications Decency Act provides that “No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.”

14. PUBLIC FIGURE DOCTRINE

Many individuals who appear in arrest records may be considered public figures or limited-purpose public figures under defamation law by virtue of their involvement with the criminal justice system. Users acknowledge that statements about matters of public concern and public figures receive heightened constitutional protection.

15. DORMANT COMMERCE CLAUSE

Users recognize that state laws attempting to regulate internet content across state lines may be unconstitutional under the Dormant Commerce Clause of the United States Constitution, which prohibits states from unduly burdening interstate commerce. As a Nevada-based service, Arre.st’s operations constitute interstate commerce that should not be subject to inconsistent regulations from multiple states.

16. NOT A CONSUMER REPORTING AGENCY (FCRA DISCLAIMER)

Arre.st is not a Consumer Reporting Agency as defined by the Fair Credit Reporting Act (“FCRA”), and the information provided on this site does not constitute “consumer reports” as contemplated by the FCRA. You agree not to use any information obtained from this Website to determine an individual’s eligibility for credit, insurance, employment, or any other purpose covered by the FCRA.

17. USER CONDUCT & PROHIBITED USES

In addition to the restrictions set forth in Section 10, you agree not to use the Website in any way that:

18. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Arre.st, US Support LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:

  • Your use of the Website;
  • Any violation by you of these Terms;
  • Your violation of any third-party rights, including but not limited to any intellectual property or privacy right;
  • Any content you submit or otherwise make available through the Website.

This indemnification includes claims arising out of acts or omissions by anyone accessing the Website using your device or account, regardless of whether such access is authorized by you.

19. NO LEGAL ADVICE

Nothing on this Website constitutes or should be construed as legal advice. Arre.st is not a law firm, and no attorney-client relationship is formed by your use of this Website. If you require legal counsel, please consult a licensed attorney in your jurisdiction.

20. DISPUTE RESOLUTION & ARBITRATION

  1. Arbitration Agreement
    Any dispute, claim, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this Agreement to arbitrate, shall be determined by binding arbitration in the State of Nevada, before a single arbitrator.
  2. Administration and Rules
    The arbitration shall be administered by a recognized arbitration body in accordance with its applicable rules. Judgment on any award rendered by the arbitrator may be entered in any court of competent jurisdiction.
  3. Waiver of Class Actions
    You hereby waive any right to a trial by jury and to participate in a class action, either as a class representative or a class member.
  4. Exception — Equitable Relief
    Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from a court of competent jurisdiction in order to protect its intellectual property rights, pending completion of arbitration.

21. DMCA / COPYRIGHT POLICY

To the extent any content on this Website could be subject to copyright protection, Arre.st respects the intellectual property rights of others and will respond expeditiously to notices of alleged infringement that comply with the Digital Millennium Copyright Act (“DMCA”). If you believe any content on this Website infringes your copyright, please provide a written notice containing all of the information required by 17 U.S.C. § 512(c).

22. ERRORS & OMISSIONS / NO RELIANCE

All data on Arre.st is gathered from public records. While we strive to keep our information accurate and up-to-date, Arre.st makes no representations, warranties, or assurances as to the accuracy, currency, or completeness of the information provided. You assume full responsibility for verifying the information before relying on it in any way. Under no circumstances will Arre.st be liable for any errors or omissions in the content, or for any loss or damages of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the Website.

23. CHANGES TO THESE TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use the Website after those revisions become effective, you agree to be bound by the revised Terms.

24. RESERVATION OF RIGHTS

We reserve the right to remove, block, or restrict any user, content, or account from this Website at our sole discretion and without notice, for any reason or no reason at all, including but not limited to breaches of these Terms.

25. SEVERABILITY & ENTIRE AGREEMENT

Severability: If any provision of these Terms is deemed to be invalid, illegal, or unenforceable, such provision shall be stricken from these Terms and the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms, together with any additional policies referenced herein, constitute the entire agreement between you and Arre.st with respect to your use of the Website and supersede all prior or contemporaneous agreements or understandings.
